Abstract
Restorative Justice programmes have been known as measures that would not deprive juvenile offenders of their liberty. Taking Vietnam as an example, the paper raises the question of how mediation in the community - a sign of restorative justice programs in Vietnam - should be improved. This paper analyzes the Criminal Code 2015 (amended and supplemented in 2017), the Criminal Procedure Code 2015 (amended and supplemented in 2021), and guideline documents regarding mediation in the community. Based on these analyses, the legal regulations on mediation in the community have some inadequacies that have hindered its implementation. As a result, some recommendations shall be suggested to improve relevant provisions from the perspective of restorative justice programs in Vietnam.
